Last updated: September 29, 2026

These Terms and Conditions ("Terms") govern your use of fantechmortgagetech.com (the "Website"), which is operated by Fantech Labs ("Fantech", "we", "us", "our") under the name Fantech Mortgage Tech. By accessing or using the Website, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website.

1. Who May Use the Website

The Website is intended for businesses and professionals, including mortgage brokerages, lenders, and their staff, in Canada and the United States. You must be at least 18 years old and have the authority to accept these Terms on behalf of yourself or the business you represent.

2. About Our Services

Fantech Mortgage Tech is a software development and technology company. We provide technology and consulting services to mortgage businesses, including workflow reviews, technology audits, automation, CRM and system integrations, and custom portals and applications. The Website describes these services and lets you contact us.

Information on the Website is not an offer to provide services on specific terms. Any project or paid service is governed by a separate written agreement, such as a proposal, statement of work, or master services agreement. If that agreement conflicts with these Terms, the written agreement applies to that work.

3. No Mortgage, Legal, or Financial Advice

Fantech is a technology provider. We are not a mortgage broker, lender, or financial institution, and we do not arrange, originate, or advise on mortgages or other credit. Content on the Website, including blog posts, case studies, and statements about compliance, is general information only. It is not legal, regulatory, financial, or mortgage advice. You are responsible for your own compliance with laws and regulations that apply to your business, including licensing, privacy, consent, and record-keeping rules. Please get advice from a qualified professional for your situation.

4. Results and Case Studies

Case studies, testimonials, statistics, and performance figures on the Website describe specific past projects. Results depend on each client's systems, data, and processes, and we do not promise that you will achieve the same or similar results.

5. Acceptable Use

You agree not to:

  • Use the Website in a way that violates any law or regulation
  • Attempt to gain unauthorized access to the Website, our systems, or other users' data
  • Introduce viruses, malware, or other harmful code
  • Scrape, copy, or harvest content or data from the Website by automated means without our written permission
  • Interfere with or disrupt the operation or security of the Website
  • Submit false, misleading, or unlawful information through our forms
  • Submit borrower personal information or other sensitive data through the Website forms (see our Privacy Policy)

6. Your Submissions

If you send us information through the Website or by email, you confirm that you have the right to share it. You allow us to use it to respond to you and to provide and improve our services, as described in our Privacy Policy. We do not claim ownership of your business information.

7. Intellectual Property

The Website and its content, including text, graphics, logos, designs, software, and the Fantech Labs and Fantech Mortgage Tech names, are owned by Fantech or its licensors and are protected by copyright, trademark, and other laws. You may view and print pages for your own internal business use. You may not copy, modify, distribute, sell, or create derivative works from any content without our prior written permission. Ownership of work delivered to clients is governed by the written agreement for that work.

8. Third-Party Links and Services

The Website may link to third-party websites, tools, or platforms, and may mention third-party products (for example CRM or loan origination systems). We do not control or endorse them and are not responsible for their content, availability, or practices. Product and company names belong to their respective owners, and their use on the Website does not imply affiliation or endorsement.

9. Disclaimer of Warranties

The Website and its content are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee that the Website will be uninterrupted, error-free, or free of harmful components, or that its content is complete, current, or accurate.

10. Limitation of Liability

To the fullest extent permitted by law, Fantech and its directors, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising from your use of, or inability to use, the Website, even if we were told such damages were possible. Our total liability for any claim relating to the Website will not exceed CAD $500. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law. This section applies only to your use of the Website and does not change the liability terms of any written services agreement.

11. Indemnification

You agree to defend and indemnify Fantech against third-party claims, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms or your unlawful use of the Website.

12. Privacy

Our Privacy Policy explains how we collect and use personal information and forms part of these Terms.

13. Suspension and Termination

We may suspend or restrict your access to the Website at any time, without notice, if we believe you have breached these Terms or if needed for security or legal reasons. Sections that by their nature should continue (such as intellectual property, disclaimers, limitation of liability, and indemnification) survive termination.

14. Changes to the Website and These Terms

We may change or discontinue any part of the Website, and may update these Terms from time to time. The "Last updated" date shows the latest version. Your continued use of the Website after changes means you accept the updated Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there, without regard to conflict-of-law rules. You agree that the courts of Calgary, Alberta have exclusive jurisdiction over any dispute relating to these Terms or the Website, except where the law of your location gives you the right to bring a claim elsewhere. Before starting a formal claim, we ask that you contact us so we can try to resolve the issue informally.

16. Language

You have expressly requested that these Terms and related documents be drawn up in English. Vous avez expressément exigé que les présentes conditions et les documents connexes soient rédigés en anglais.

  • Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and us about the Website.
  • Severability: If any part of these Terms is found unenforceable, the rest stays in effect.
